§ 7001. Pension

All employees of the municipality of San Juan who are employees within the Employees’ Retirement System of the Government of the Commonwealth of Puerto Rico and its instrumentalities, who as of July 1, 1998, have completed twenty-four and one half (24 1 / 2 ) years or more of creditable services, and who voluntarily accept it, including those who having completed said term of services, and who because of their classification or of the program from which at one time they earned their salaries, were not included by the municipality among the employees in the retirement system, shall be entitled to receive a pension from the system as provided below:

(a) Employees who have completed twenty-four and a half (24 1 / 2) years or more of creditable services and who have not attained the age of fifty-five (55) years or more, shall receive a pension of sixty-five percent (65%) of the average salary.

(b) Employees who have completed twenty-four and a half (24 1 / 2) years or more of creditable services and who have attained the age of fifty-five (55) years or more, shall receive a pension of seventy-five percent (75%) of the average salary.

(c) Employees who have completed thirty (30) or more years of creditable services and who have not attained the age of fifty-five (55) years, shall receive a pension of seventy-five percent (75%) of the average salary.
