Whenever the agency proposes to adopt, amend, or repeal a rule or regulation, it shall publish a notice in Spanish and English, in not less than one newspaper of general circulation in Puerto Rico, and in Spanish and English on the Internet. Provided, That if the adoption, amendment, or repeal of the rule or regulation affects a specific residential community, the agency shall also publish the same notice in a regional newspaper that circulates in the area where said community is located, and it shall also schedule an advertisement in the local radio station of largest audience or nearest to the affected community on at least two (2) occasions at any time within 7:00 in the morning and 7:00 in the evening. The radio advertisement shall indicate the date on which the notice was published in the newspaper. The radio advertisement, as well as the notice, shall contain a summary or brief explanation of the purpose of the proposed action; a reference to the legal provision that authorizes said action, and the form, place, days, and hours that comments can be submitted in writing or by electronic mail, or a written request, including the grounds on which the petitioner bases said request, for an oral hearing on the proposed action can be made, and the place or web address where the full text of the regulations to be adopted will be available to the public. Upon receiving comments by electronic mail, the agency shall issue an electronic receipt of the same within two (2) business days of its date of receipt. The notice published in the newspaper shall also contain the web address of the website where the agency has chosen to publish the notice on the Internet, and the complete text of the rule or regulations.
Every notice of proposed adoption of regulations that has been published or is to be published pursuant to the provisions of this section shall be exempted from the application of the provisions of § 3351 of Title 16.
