§ 830a. Special Permanent Commission—Composition

The Special Permanent Commission, henceforth the Commission, shall be composed of ten (10) members as follows: one (1) member of the House of Representatives, one (1) member of the Senate of Puerto Rico; four (4) members representing each one of the following retirement systems existing in Puerto Rico, to wit: of the Employees of the Government of Puerto Rico and its Agencies, of the Judiciary, of the University of Puerto Rico, of the Teachers; two (2) members, one (1) who shall represent the Pensioners Association of the Government of Puerto Rico and another who shall represent the Employees Association of the Commonwealth of Puerto Rico. The other two (2) additional members who shall represent the public interest shall be citizens who have broad knowledge and experience in the actuarial, finance, and insurance fields.

The Boards of Trustees or Directors of each system or association shall designate one regular member and another alternate member to represent it on the Commission. The ex-officio members of a Retirement Board or of a Board of Trustees shall not be selected as members of the Commission. Provided, further, that if there were no participants on the Board of Trustees of the Puerto Rico Government Employees Retirement System to cover the positions of regular and alternate members representing the Puerto Rico Government Employees Retirement System and the Judiciary Retirement System, said Board shall designate the participants in charge as members of the Commission, in the first place, and select the remaining members from those participants of both systems who have been members of said Board of Trustees.

The two (2) Commission members from the Legislature shall serve for the term of six (6) years or as long as they are in office as members of the Legislature.

The Presidents of each Body shall have the power to designate the legislators who shall be members of the Commission as well as those officials and employees of the Legislature and its offices whom they deem proper to appoint to the Commission.

The members who represent the Retirement Systems of the Pensionees Association and the Commonwealth of Puerto Rico Employees Association shall serve for the term of their office as bona fide members of their respective Boards of Directors or Trustees, but never for a term longer than six (6) years. When the members selected or designated by the Board of Trustees of the Government Employees Retirement System are not members thereof, the term of appointment shall be of three (3) years and the appointment shall not be extended for more than two (2) consecutive terms. The two (2) members who represent the public interest shall be appointed by the Governor of Puerto Rico with the advice and consent of the Senate for a term of four (4) years and shall serve until their successors are appointed and take office. They shall not be appointed for more than two (2) consecutive terms.

The Commission’s members shall designate a Chairman from among themselves and shall approve the rules they consider necessary or convenient for the effective performance of the Commission. Six (6) members shall constitute a quorum.

The Commission’s powers shall not be affected by a vacancy which shall be filled by a person who represents the group to which the former member belonged and who was appointed in the same manner as he was.
