§ 704b. Transfer without discrimination or hardship; consent of personnel

The transfers of personnel ordered by the Governor through executive order shall be made maintaining the greater fairness in the proceedings, to avoid prejudice and having due consideration of the security and protection given by the Personnel Act to the Government personnel.

No personnel may be transferred when said transfer may result in a more onerous situation for the personnel transferred. The new duties required of said personnel may not receive a lower compensation, neither shall require to perform duties of a higher classification, or that may require skills different or superior than those of his former office or position; or the necessity of moving his home, or rendering his services at an unreasonable distance as compared to the distance travelled to and from his former office. In these cases, there shall be needed the consent of the personnel to be transferred.
