§ 429i. Indemnification of damages

The damages caused to property of the Commonwealth of Puerto Rico, including those of public and community domain, its agencies and instrumentalities, by acts performed in violation of the regulations herein approved or by action or omission in which negligence is involved, shall be indemnified for their total sum, but in the cases of gross negligence or contempt of court in the performance of the act or omission which caused the damage, the court, at its discretion may impose, in addition to the total sum for the indemnification of the damages, a penalty of up to three times that of the total sum. When the damages are caused to the property of a private citizen, the court may at its discretion, impose a penalty up to three times that of the sum.
