§ 187. Penalties; administrative fines

(a) Any natural or juridical person who violates the provisions of §§ 171—190 of this title or the regulations issued by the Department of Health thereunder shall incur a misdemeanor, and upon conviction, may be sentenced to imprisonment that shall not exceed six (6) months, or a fine of not more than five thousand dollars ($5,000), or both penalties in the discretion of the court. In addition to the penalties imposed by the court, the penalty of restitution shall be imposed.

(b) Any natural or juridical person who violates the provisions of §§ 171—190 of this title or the regulations set forth by the Department of Health hereunder for the first time, shall be liable for an administrative fine of not more than five thousand dollars ($5,000), as provided in §§ 2101 et seq. of this title, known as the “Uniform Administrative Procedures Act”; in the case of a new violation of this chapter or the regulations set forth by the Department by virtue thereof within the term of one (1) year, the fine imposed may be raised to a maximum of ten thousand dollars ($10,000).
