§ 8800. Benefits

(a) The employees dismissed pursuant to the provisions of § 8795 of this title shall receive the liquidation of the regular vacations leave once they present the documents required for such liquidation. Likewise, those eligible employees shall receive the liquidation of accumulated sick leave and overtime.

(b) The employees dismissed pursuant to the provisions of § 8795 of this title, shall be paid the premium of the health insurance for an uninterrupted term of six (6) months or until he/she is eligible for health insurance in another employment.

(c) The employees dismissed pursuant to the provisions of § 8795 of this title shall be considered eligible for the Public Employees Option Program, as provided in § 8803 of this title.

(d) Layoffs by virtue of the provisions of § 8795 of this title shall not be considered that the employee was terminated for improper conduct for the purpose that an insured employee is not disqualified from receiving the benefits provided by §§ 701 et seq. of Title 29, known as the “Employment Security Act of Puerto Rico” (unemployment), if eligible.
