§ 4884. Negotiations incompatible with the discharge of public office

Any public officer or employee who, by reason of his/her office, directly or through third party, promotes, authorizes or executes a contract, bid or any other operation in which he/she has an interest without having a dispensation or authorization allowed by the law shall incur a fourth degree felony.

The third party thus benefitted shall also incur this felony.

A third degree felony sentence shall be imposed if the person obtains the benefit pursued.

The court may also impose restitution.
