§ 4826. Robbery

Any person who unlawfully takes personal property belonging to another in the immediate presence of said person and against his/her will by means of force or intimidation shall incur a third degree felony.

Any person who unlawfully takes personal property and immediately after having committed the act uses force or intimidation against another to retain the taken item shall also incur a third degree felony.

The court may also impose the penalty of restitution.
