The penalty of restitution consists of the obligation imposed by the court on the juridical person to pay the victim for the damages and losses caused to his/her person and property as a consequence of the criminal act.
The penalty of restitution shall be set by taking into consideration the social capital of the juridical person, the state of business, the nature and consequences of the crime, and any other relevant circumstance.
