No child shall file civil suit against his/her parents for damages and losses when the family unit, the institution of patria potestas, and the relationship between parents and children are affected. Provided, That said prohibition shall not be absolute and that the suit for damages may be exercised when there is no family unit to protect nor any relationship between the parents and their children to preserve.
