§ 4877. Qualifications of surety; jurisdiction of court

A party who is bound to give security must present a person having capacity to bind himself, and with sufficient property to answer for the obligation which he guarantees. The surety shall be understood as subject to the jurisdiction of the court or judge of the place where this obligation is to be fulfilled.
