§ 3743. When price considered fixed

In order that the price may be considered fixed, it shall be sufficient that it be fixed with regard to another determinate thing also specific, or that the determination of the same be left to the judgment of a specified person.

Should such person not be able to or not wish to fix the price, the contract shall be of no effect.
