§ 3402. Who cannot give consent

The following persons cannot give consent:

(1) Minors who are not emancipated. However, minors between 18 and 21 years of age who are engaged in commerce or industry may carry out all civil acts for its administration, without requiring the consent of their parents.

(2) Lunatics or the insane, and the deaf and dumb who do not know how to write.
