§ 2791. Person inheriting by will and ab intestato

Any person designated to an inheritance by a will and ab intestato and who repudiates it in the first capacity is considered as having repudiated in both characters.

Should he repudiate it as an intestate heir and without having knowledge of his testamentary character, he may yet accept it in the latter capacity.
