§ 2477. Legacy of things belonging to legatee

The legacy of a thing, which at the time of the execution of the will already belonged to the legatee, even though another person has some right thereto, shall not have any effect.

If the testator expressly orders that the thing should be freed from this right or charge the legacy shall be valid in that respect.
