The author or rightful claimant may not invoke moral rights when the work is legitimately used for purposes of criticism, parody or news, educational, or investigative comment. To determine whether the use is covered under this exception, the total of the circumstances shall be taken into account, including:
(a) The purpose of the use;
(b) The nature of the work, and
(c) The size and content of the part used as related to the work as a whole.
