§ 1281. Procedure for division

The division of a thing held in common may be made by the interested parties or by arbitrators or friendly compromisers, appointed at the will of the part-owners.

In case it is made by arbitrators or friendly compromisers, they shall divide it into parts proportional to the rights of each part-owner, avoiding, as far as possible, payments of balances in cash.
