§ 1261e. Penalties

(1) Except as otherwise expressly provided herein, any person who willfully violates any of the provisions of this chapter or any regulation promulgated or order issued hereunder shall be guilty of a violation punishable as a misdemeanor. Each such violation shall be deemed a separate offense. For purposes of this section, a willful violation shall be deemed to have occurred when the person committing or responsible for the violation knew or reasonably should have known that his conduct was violative of any provision of this chapter or any applicable regulation or order.

(2) If, upon investigation by the Company, a person is determined to have violated this chapter or any regulation promulgated or order issued hereunder, the Company shall inform such person of the violation by certified mail, return receipt requested, and may assess a monetary fine which shall not exceed ten thousand dollars ($10,000) for each violation. The Company, in the name of Puerto Rico, may initiate legal proceedings in an appropriate court of competent jurisdiction in order to enforce payment of any such monetary fine that is not paid within ten (10) calendar days following the Company’s giving of such notice.
