§ 1257. In general

It shall be unlawful for any person offering timeshares, vacation club rights or accommodations within Puerto Rico intentionally to authorize, use, direct, or aid in the dissemination, publication, distribution, or circulation of any statement, advertisement, broadcast, or telecast concerning the timeshare plan or vacation club in which such timeshares, vacation club rights or accommodations are offered, which contains any statement, characterization, or depiction, either written or graphic which is false or misleading, including, without limitation, showing proposed improvements or nonexistent scenes without clearly indicating that the improvements are proposed and the scenes do not exist.

Nothing in this section shall be construed to hold the publisher of any newspaper, any job printer, any broadcaster or telecaster, any magazine publisher, or any employee thereof, liable for any publication, dissemination, distribution, or circulation herein prohibited unless such person had actual knowledge of the falsity thereof.
