§ 1809. Satisfaction of judgment

Satisfaction of the judgment which has become a lien, as above provided for, may be shown in whole or in part:

(1) By the return upon an execution issued upon said judgment, or by a certified copy of such return, certified by the secretary of the court to which the return was made, such certificate showing the names of the parties to the judgment, the number and style of the suit, the date and amount of the judgment, the court in which rendered, and the date of issuance and return of the execution; and the secretary shall collect a fee of fifty cents for such certificate.

(2) By a discharge in bankruptcy, which shall be proven by presenting to the registrar a duly certified copy of the judgment of the court wherein the bankruptcy proceedings were had, showing the discharge of the defendant or defendants named in the judgment sought to be satisfied, and a certificate, duly authenticated under the seal of said court, showing that the debt represented by the recorded judgment is one covered by the bankruptcy proceeding.

(3) By a receipt, acknowledgment or release, signed by the party entitle to receive the payment of the judgment, or his agent or attorney of record with sufficient power, and duly acknowledged before a notary public.

If the party executing the release is not known to the notary public, he shall require proof of his identity before authenticating the release, and for that purpose may take the oath of a credible witness, which shall be noted in the certificate. If the party is known to the notary, the certificate shall so state.

The form of the notary’s certificate shall be substantially as follows:

Commonwealth of Puerto Rico, Municipality of............... ss. Before me,............................, a notary public in and for Puerto Rico, on this day personally appeared................, known to me (or proved to me on the oath of.................., a credible witness) to be the person whose name is subscribed to the foregoing satisfaction of judgment, and acknowledged to me that he executed the same for the purposes and considerations therein expressed. Given under my hand and seal of office, this................... day of..........., 19..........., at........... (Seal)........................... Notary Public of Puerto Rico
