§ 2416. Closed lease—Expiration of term

In closed lease cases, when the term of the contract has expired, the lessee is bound to voluntarily hand over the leased chattel when due. This shall not apply in those cases in which the lessee has an option to purchase previously granted by the lessor. The lessee shall also pay the expenses incurred for the delivery and transportation of the leased chattel.

If the lessee does not deliver the leased chattel, the lessor may file a civil suit to recover the personal property from the lessee, in addition to the expenses incurred in filing the suit. The lessee shall also be liable for damages to the chattel until he/she delivers it or the lessor recovers it with the court’s assistance.
