§ 1707. Damage to goods before delivery

The loss or impairment of the goods before their delivery, on account of unforeseen accidents or without the fault of the vendor, shall entitle the purchaser to rescind the contract, unless the vendor has constituted himself the depositary of the merchandise, in accordance with § 1715 of this title, in which case his liability shall be limited to that arising by reason of the deposit.
