§ 792. Penalties

(a) The Commissioner is hereby authorized to impose or collect administrative fines of not less than one hundred dollars ($100) or more than five thousand dollars ($5,000) for each violation of the provisions of this chapter or the provisions contained in the rules and regulations promulgated by virtue thereof, or in the orders or resolutions issued by the Commissioner.

(b) When the nature of the violation of this chapter or of the rules and regulations or orders and resolutions issued by the Commissioner so justify, he/she may file criminal action against the offender, in addition to the imposition of the administrative fine authorized above.

(c) Except as otherwise provided in any section of this chapter, each violation of the provisions of this chapter or the provisions contained in the rules and regulations promulgated by virtue thereof, or the orders and resolutions issued by the Commissioner, shall constitute a misdemeanor punishable by a fine of not more than five hundred dollars ($500) or by imprisonment for not more than six (6) months, or both penalties, at the discretion of the court.
