§ 225b. Rights conferred

The registration of the trade name in the Department of State of Puerto Rico is optional and confers the registered owner the exclusive right to use the same for commerce in Puerto Rico.

However, the prior user of a trade name may request the Secretary to cancel a trade name that may be confused with his/her own, provided that such claim is exercised before five (5) years have elapsed from the registration of the challenged trade name.
