§ 633. Misuse of public funds

Any public employee or official who illegally uses public funds or disposes of public property to be used by a political party, aspirant, candidate, campaign committee, or political action committee, shall be guilty of a felony and, upon conviction, shall be punished by imprisonment for a minimum term of one (1) year and a maximum term of three (3) years, or by a fine that shall not be less than five thousand dollars ($5,000) or more than ten thousand dollars ($10,000), or both penalties, at the discretion of the court. The court may also impose a penalty of restitution.

The criminal action for this felony shall prescribe within five (5) years.
