§ 622e. Powers and duties of the Secretary of the Office of the Election Comptroller

In addition to any other functions or duties provided in this chapter or the regulations promulgated thereunder, the Secretary shall:

(a) Take minutes of the regular and special meetings of the Board of Election Comptrollers.

(b) Have voice but not be part of the quorum or of the consensus required for reaching the determinations of the Board of Election Comptrollers.

(c) Call the special meetings of the Board of Election Comptrollers, as established in this chapter.

(d) Take notes, draft, and prepare minutes of the administrative hearings of the Board of Election Comptrollers or the Office of the Election Comptroller, as well as certify them.

(e) Certify, compile, notify, and publish the resolutions, orders, opinions, and determinations of the Board of Election Comptrollers and the Office of the Election Comptroller.

(f) Receive briefs, documents, notifications, and other matters that may be filed with the Board of Election Comptrollers and the Office of the Election Comptroller for consideration and/or resolution.

(g) Notify the Board of Election Comptrollers and the Election Comptroller about the receipt of any documents, briefs, appeals, notices, and other matters presented to him/her, not later than twenty-four (24) hours following the receipt thereof; Provided, That five days (5) before the holding of an election he/she shall notify so immediately.

(h) Notify interested parties, through the corresponding means, about resolutions, orders, determinations, and actions of the Board of Election Comptrollers and the Office of the Election Comptroller.

(i) Issue certifications and records of the documents, opinions, and other determinations of the Board of Election Comptrollers and the Office of the Election Comptroller.

(j) Be responsible before the Board of Election Comptrollers and the Election Comptroller for the custody and proper order of all records and documents pertaining to the Office of the Election Comptroller.

(k) With the exception of those documents classified as confidential under this chapter, present and show the records and documents pertaining to the Office of the Election Comptroller to any person who so requests, ensuring at all times that such records and documents are not altered, mutilated, or destroyed, and not allowing their retrieval from his/her office.

(l) Administer oaths in connection with matters related to this chapter and/or those that pertain to the Office of the Election Comptroller.

(m) Refer to the Chair of the State Election Commission any issues on which the Board of Election Comptrollers is unable to reach a consensus as required in this chapter.

(n) Carry out any other actions and meet any other obligations as are necessary to fully discharge his/her duties and those prescribed by law, regulations, or order of the Election Comptroller or the Board of Election Comptrollers.
