§ 561. Certification of checks, penalty for fraud

Neither the Bank nor any officer, agent or employee thereof shall certify any check drawn upon it unless the drawer of such check has on deposit with the Bank at the time such check is certified an amount not less than the amount of such check. Any check so certified by a duly authorized officer, agent or employee of the Bank shall be a valid obligation of the Bank in the hands of any person holding such check in good faith; but any officer, agent or employee of the Bank who knowingly acts in violation of the provisions of this section shall be deemed guilty of a misdemeanor and shall be liable to imprisonment for not less than one nor more than two years.
