§ 5455. Illegal acts and penalties

Any person who violates the provisions of §§ 5452, 5453 and 5454 of this title shall incur an administrative fault and be punished with a fine of two hundred and fifty dollars ($250) for each violation. In the case of violation of the standards relative to the weight of the vehicles and their cargo, the fines provided in § 5685(c) of this title shall also apply, whichever is greater.

When any person is injured or dies due to the violation of the provisions of this subchapter, the person accused shall incur a misdemeanor and, upon conviction, shall be punished with a fine of not less than five hundred dollars ($500), nor of more than five thousand dollars ($5,000), a term of imprisonment of not more than six (6) months, or both penalties, at the discretion of the court. The court may suspend the driving license of the convicted driver for a term of not more than two (2) years.
