§ 320. Definitions

For the purposes of §§ 320—320 l of this title, the following terms and phrases shall have the meaning stated below:

(a) Beneficiary.— Means a person who owns, manages or is in charge of an establishment to receive, purchase and process ripe and green coffee beans on a commercial scale, to submit it to the cleaning, washing and drying process which leaves it as dry and hulled coffee beans.

(b) Roaster.— Means a person who owns, manages or is in charge of an establishment to receive, purchase, roast, grind and sell coffee to be sold to the consumer.

(c) Coffee.— Means the bush belonging to the Rubiaceae family, Coffea genus, with perennial, coriaceous, single leaves and [opposing] white, aromatic axillary flowers whose fruit is a berry, red, white and yellow in color, that generally contains two seeds from which the beverage known by the same name is produced, among other byproducts.

(d) Coffee farmer or producer.— Means any person who owns, leases, is the usufructuary or is, himself, the middleman, or through his/her representative agents, managers, employees, or others, devotes any part or all of his/her lands to the agricultural activity of sowing, cultivating, harvesting or processing coffee.

(e) Importer.— Any person engaged in the introduction of processed or industrialized coffee to the Commonwealth of Puerto Rico from any jurisdiction including the United States of America.

(f) Department.— Means the Department of Agriculture of the Commonwealth of Puerto Rico.

(g) Secretary.— Means the Secretary of the Department of Agriculture of the Commonwealth of Puerto Rico.

(h) Person.— Is any natural or juridical person, including, but without it being understood as a limitation, a partnership, association, institution, corporation, credit union or group of persons.

(i) Purchaser.— Means any person who owns, manages or is in charge of an establishment for the purpose of buying, processing, classifying and selling [dried] coffee beans.
