When the district supervisors find that any land-use regulation is not being observed on particular lands, and that such non-observance is interfering with the prevention or control of erosion on other lands within the district, the supervisors may file in the proper part of the Court of First Instance where the lands are located, a petition setting forth the regulation, the violation of said regulation by the land occupier, and the effect of such non-observance; and praying the court to require the land occupier to perform the requirements of the regulation within a reasonable time; Provided, That supervisors shall report the non-compliance with the regulations to the Committee before filing a petition in court.
