§ 4665. Responsibilities for violations

It shall be understood that any violations of the provisions in this chapter incurred by any cooperative are also committed by the officer or employee of said cooperative who is responsible due to his/her duties, pursuant to the regulations, policies and procedures of the cooperative. If such a responsibility has not been expressly assigned to any officer or employee of the cooperative by regulations, policies and procedures, all the members of the Board of Directors and the committees of the cooperative shall be responsible, unless said member proves that he/she did not have any knowledge or that he/she took all actions possible and made reasonable efforts to prevent incurring the violation in question. The continued action or omission which constitutes a violation of the provisions in this chapter shall be considered as a new offense for each subsequent week in which the action or omission in question persists.
