§ 551b. Definitions

For the purposes of §§ 551a—551k of this title, the following terms shall have the meaning stated hereinbelow:

(a) Merchant. — Any person, firm, corporation or association that offers for sale, sells, distributes, or manufactures articles or products with the insignias protected by §§ 551a—551k of this title, or that is commercially advertised during the radio and television transmissions of this event.

(b) San Blas Marathon. — The sporting event that is held annually in the Municipality of Coamo, and that was declared a sporting event of general public interest in Puerto Rico through § 551 of this title, including the race and the ceremonials conducted as a result thereof.

(c) Organizing Entity of the San Blas Marathon. — Means the Delta Phi Delta Fraternity, duly organized as such, which is mainly responsible for the organizing and financing of the San Blas Marathon.

(d) Insignia. — Any expression, word, phrase, emblem, insignia or design that alludes to the San Blas Marathon, that is officially registered in the Department of State.

(e) Radio or Television transmission. — Means the radio and television coverage of the Marathon’s activities, including the race and ceremonials thereof, in which the same is promoted by means of advertisements of products or services. It does not include the newsworthy aspect in which the transmission is not sponsored by advertisements that conflict with the sponsors of the San Blas Marathon. Radio or television transmission shall also mean the rebroadcast coverage by radio through magnetic tape recordings, or by television through the taping of images and sound by videotape recordings.

(f) Department. — Means the Sports and Recreation Department.
