§ 1553. Council—Members

The Executive Director of the Institute of Puerto Rican Culture, who shall preside, the Secretary of Natural and Environmental Resources, the Director of the Commonwealth Historical Conservation Office of the Governor’s Office, the Executive Director of the Permit Management Office and a professional archaeologist for each one of the universities in the Commonwealth that have courses in that discipline shall be ex-officio members of the Council. These archaeologists shall be designated by the presidents of said universities in which they render their services from among the professors of said discipline, for a term not to exceed four (4) years. In the event that the professor thus appointed is no longer a member of the faculty of the university in question, the President thereof shall appoint another person for the remaining term of the member of the Council thus replaced. The Governor of Puerto Rico, with the advice and consent of the Senate of Puerto Rico, shall also appoint three (3) persons of recognized academic training or experience in the field of land archaeology and one (1) in the field of architecture. The initial appointments of these four (4) members shall be made for a term of two (2), three (3) and four (4) years, respectively, and shall stay in office until their successors are appointed and qualify. Subsequent appointments shall be made for a term of four (4) years each, until their successors are appointed and take office. In the event of a vacancy, resignation or permanent disability of any of these members, the corresponding appointments shall be made for the remainder of the term of the person [occasioning] the vacancy.

The Council shall be constituted within thirty (30) days after the effectiveness of this act. The appointments to fill vacancies that may occur in the Council shall be made following the same procedure used to appoint a replaced member.

The Governor may remove any of the members that he appoints for incompetence in the execution of duties or for any other justified cause after filing of charges and an opportunity to be heard. The members of this Council shall not receive any remuneration whatsoever for their services, but those who are not employees of the Government of the Commonwealth of Puerto Rico or its instrumentalities shall receive per diems of fifty dollars ($50) for each session they attend. All members of the Council shall be entitled to reimbursement for traveling expenses authorized by the Council. Five (5) members shall constitute a quorum to hold meetings and make decisions.

The Council shall elect from among its members one to act as secretary and another as vicepresident, each for the term of one (1) year, which can be extended by the decision of the Council.

The Council shall adopt bylaws for its organization and internal operations and shall approve and promulgate such regulations as are needed to put into effect the provisions of this chapter pursuant to Act No. 112 of June 30, 1957, known as the “1958 Regulations Act of Puerto Rico”.
