§ 1509. Council—Permits for operations; petition

Any person interested in conducting or continuing to conduct any operation for the investigation, study, exploration, excavation, recovery or salvage in an underwater archaeological site shall be bound to file a petition for the granting or renewal of the corresponding permit before the Council. This petition shall be accompanied by an environmental impact statement prepared by an investigator approved by the Executive Director of the Institute of Puerto Rican Culture and by the Secretary of the Department of Natural and Environmental Resources. The Council shall evaluate the petition and shall take the corresponding final action as to the granting, renewal, denial, suspension or cancellation of those permits. It shall be a requirement that upon granting or renewing a permit, the petitioner shall post a bond that will satisfactorily cover any damage that may be caused to the underwater archaeological site.
