§ 1474. Administrative Council—Creation

The Administrative Council is hereby created as an autonomous government entity, which shall be composed [of] nine (9) members, to wit:

(a) Two members of the Board of Directors of the Institute of Puerto Rican Culture, designated therefor by the Board of Directors itself.

(b) A representative of the Government Development Bank designated by the President of said Bank.

(c) Six (6) citizens representing the public interest who shall be appointed by the Governor of Puerto Rico with the advice and consent of the Senate of Puerto Rico.

All the representatives of the public interest appointed by the Governor shall be persons of recognized ability, knowledge, appreciation of our cultural values and who have distinguished themselves in the defense of these values. At least three (3) of the nine (9) members who compose the Board shall have knowledge and experience in the fields of finance and administration.

Three (3) of the Council members who represent the public interest shall be initially appointed for a term of four (4) years and the remaining three (3) shall each be initially appointed for a term of three (3) years. Upon the expiration of the first appointments subsequent appointments shall be made for a term of four (4) years each. Upon the expiration of the term of their appointment, the persons shall remain in office until their successors are appointed and take office. In the event of a vacancy the Governor shall make a new appointment for the unexpired term of the one who [occasioned] it.

The Chairperson of the Administrative Council shall be designated by the majority vote of the Council members and all decisions and resolutions shall be made by the affirmative vote of at least five (5) members.

The members of the Council shall not receive a salary, but those who are not public officials or employees shall be entitled to payment of per diems of fifty dollars ($50) for each day or fraction thereof that they attend Council meetings. They shall be entitled to payment of travel expenses incurred to carry out such services in accordance with Treasury Department Regulations to that effect.

The Council shall meet as many times as necessary, but no less than six (6) times a year.
