§ 921k. Regulations

The Executive Director shall adopt the following regulations, among others, subject to the approval of the Governor and the Secretary of the Treasury when necessary:

(a) To establish the organization and functioning of the Program.

(b) To establish criteria for the eligibility of candidates to participate in the Program and the mechanism for their selection; Provided, That as a requirement for their participation, the students shall have to maintain an academic grade point average equal to or higher than 3.00 during the academic year prior to the trip, except for regular students with disabilities registered with the Office of the Assistant Secretary for Integral Educational Services for Persons with Disabilities, who shall be exempted from complying with such requirements. Depending on the disability, said students shall be entitled to travel with a tutor paid by the Government; said tutor shall knowledgeable about and be able to attend to their physical and particular limitations.

(c) To establish the requirements which the participants and the young people who are selected must meet.

(d) To coordinate efforts with other government or private institutions.

(e) To use the economic resources provided for the Program.

(f) To establish the systems to be used to publicize the experiences of the young participants.

(g) To promulgate norms leading to the establishment of public liability and medical insurance to cover the students who travel and the persons or officials who accompany them.

(h) To establish the procedure for testing all participating students and accompanying adults for the use of controlled substances.

(i) To establish a psychosocial assistance program for students who test positive in drug tests administered by the Student Travel Program. Provided, That if said young persons successfully complete such program and remain active in a study program, they have the opportunity of participating in the student trip the following year. These students shall be exempted from complying with the selection by drawing requirement.

(j) To adopt the rules for the selection of persons (accompanying adults) who shall supervise the activities of participating students. Except for accompanying adults and the above stated, under no circumstances may a person who has not been selected by means of the drawing system participate in the Program.

(k) To adopt the norms relative to the creation of spaces for other students who meet the academic grade index requirements so they may participate in the Program even though they have not been selected through the drawing system, by defraying the cost of their participation through the sponsorship of the private sector or from their own pocket.

(l) To cover all matters not expressly provided in this chapter but that are compatible with the functions and faculties provided by law for the Program.

All regulations adopted pursuant to the authority conferred by this chapter and duly promulgated shall have the force of law.
