(1) The provisions of this chapter shall apply to any natural or judicial person, or group thereof, that operates a higher education institution in Puerto Rico; or that somehow states, promises advertises or expresses its intention to grant degrees, diplomas, certificates, or other higher education official academic recognition in Puerto Rico.
(2) This chapter shall not apply to courses and programs leading to religious degrees, whose sole purpose is to prepare students to obtain positions or perform work in the religion or sect to which they are oriented.
(3) The Council shall not exercise jurisdiction on the offerings of institutions which provide educational services leading to higher education degrees in military establishments of the United States Armed Forces located in Puerto Rico, if the same are circumscribed to students in active military service and their dependents; but it shall exercise it when they are offered to other civilians. In the latter cases, on exercising its jurisdiction, the Council shall observe the policy established to such respect by the Congress of the United States.
