§ 126a. School buildings, granting use

(a) The Secretary of Education of Puerto Rico is hereby authorized to grant the free use of public school buildings, whether owned or leased by the Commonwealth, to groups or associations of citizens and to organizations with political purposes for the holding of lawful meetings and activities not for purposes of recreation or festivity or for political proselytism. The activities for which the use of the public school buildings is granted shall not be for profit and the sale of admission tickets to attend said activities shall be prohibited. The use granted shall be of a sporadic nature and shall not constitute a cession of permanent or continuous use. The Secretary of Education shall establish by regulations the requirements that shall be met and the warranties that shall be given by the organizations using the public school buildings to answer for damages to the school property and the didactic material or equipment existing in the classrooms or around the school where such activity is held.

(b) The activities held in school buildings according to this section shall take place outside the regular school hours. In accordance with this section the activities considered of an extraordinary character shall be the following: primaries, assemblies for the organization of parties, instructions to enumerators and poll officials and general elections.

(c) Upon the facilities whose use is hereby authorized no posters, paintings, bills, advertisements or political identification whatsoever may be posted that cannot be removed at the end of the activity.

Any natural or [juridical] person who uses the school facilities herein authorized shall be under obligation to remove all the material carried to or used in the meeting, leaving the facilities in the same conditions in which he received them at the time of beginning the meeting or activity.

(d) Any natural or [juridical] person who violates the provisions of this section shall be guilty of a misdemeanor.

(e) The Secretary of Education shall require from the entities using the classrooms of the public schools for their activities to deliver them in the same physical conditions they were at the time of using them and with the equipment and didactic material that existed in the classroom; Provided, That if they fail to do so, the Secretary may deny them the use of the school facilities for other activities for a specific time or until they compensate for or replace the equipment disappeared or damaged and repair the damage caused to the building. He shall be further empowered to prescribe the necessary rules and regulations to carry out the purposes of this section.
