§ 442. Evaluation and planning for the individualized education program

Once it is established that the student is blind or partially blind, the education of said student shall be fundamentally accomplished through the Braille System, unless the Multidisciplinary Committee for Placement certifies that, based on the student’s evaluation, Braille is not the adequate method for said student. Said student must have access and if he so wishes may benefit from services or features of technological assistance.

The certification must justify, in terms of long-range academic benefit for the student, that the Braille System is not the adequate method for the student’s education. The student’s parents or custodians shall have the power to request that the student is taught fundamentally in Braille.

The document of the individualized education program must include:

(1) Medical certification about the student’s visual status.

(2) How education will be provided to the student using the Braille System.

(3) Time period during which Braille shall be taught.

(4) A determination of the level of reading comprehension and writing comprehension intended to be reached during such time period and the parameters used to measure them.
