§ 446c. Interviewing minors without prior notice

The Department may interview a minor without the need for a court order and without prior notice to the father, mother, or other person responsible for the minor when it has knowledge of or suspects that the minor is a victim of abuse, institutional abuse, neglect, and/or institutional neglect and when notifying the father, mother, or other person responsible for the minor would increase the risk of serious harm to the minor or to another person. The Department may also hold an initial interview with the minor when the minor contacts the Department or a person who provides protective services.

The interview may be held in a public or private school, hospital, police station, or any other location where the safety of the minor can be guaranteed. School directors, supervisors, teachers, and other school employees shall be obliged to allow the representatives of the Department to meet with and interview the minor during school hours. They shall provide an appropriate place and conditions to ensure the confidentiality of the process.
