Any person, whether a participant [in] the Food Stamp Program or not, who knowingly uses, transfers, acquires, alters or possesses food stamps or authorizations for food stamps worth one hundred dollars ($100) or more not authorized in any way by the Federal Food Stamp Act and/or the Federal Department of Agriculture or any regulations approved by virtue of said Act, shall be guilty of a felony and, upon conviction, shall be punished by imprisonment for a term of not more than five (5) years nor less than one (1) year, or a fine of not more than ten thousand dollars ($10,000) nor less than one thousand dollars ($1,000), or both penalties at the discretion of the court.
Any person, whether a participant of the Food Stamp Program or not, who knowingly uses, transfers, acquires, alters or possesses food stamps or authorizations for food stamps worth less than one hundred dollars ($100) not authorized in any way by the Federal Food Stamp Act and/or the Federal Department of Agriculture or any regulations approved by virtue of said act, shall be guilty of a misdemeanor and upon conviction shall be punished by imprisonment for a term of not more than six (6) months nor less than (30) days, or a fine of not more than five hundred dollars ($500) nor less than one hundred dollars ($100), or both penalties [at] the discretion of the court.
