Section 76-1940 - Office of superintendent provided to be appointed by secretary of human resources abolished; transfer of powers, duties and functions(a) On July 1, 1986, the office of superintendent of the Kansas soldiers' home provided for by K.S.A. 1985 Supp. 75-5719 shall be and is hereby abolished.(b) On July 1, 1986, except as otherwise provided in this act, all of the powers, duties and functions of the existing superintendent of the Kansas soldiers' home are hereby transferred to and conferred and imposed upon the superintendent of the Kansas soldiers' home provided for by K.S.A. 76-1904, and amendments thereto.(c) Except as otherwise provided in this act, the superintendent of the Kansas soldiers' home provided for by this act shall be the successor in every way to the powers, duties and functions of the superintendent of the Kansas soldiers' home abolished by this act in which the same were vested prior to July 1, 1986. Every act performed in the exercise of such powers, duties and functions by or under the authority of the superintendent of the Kansas soldiers' home provided for by this act shall be deemed to have the same force and effect as if performed by the superintendent of the Kansas soldiers' home abolished by this act in which the authority to perform such act was vested prior to July 1, 1986. The superintendent of the Kansas soldiers' home provided for by this act shall be a continuation of the superintendent of the Kansas soldiers' home abolished by this act.(d) Except as otherwise provided in this act, on and after July 1, 1986, whenever the superintendent of the Kansas soldiers' home, or words of like effect, is referred to or designated by a statute, contract or other document such reference or designation shall be deemed to mean and apply to the superintendent of the Kansas soldiers' home provided for by this act.L. 1986, ch. 278, § 7; July 1.
