Section 12-5366 - [Effective 7/1/2025] 911 state maintenance fund; creation; administrator of fund; authorized uses
(a) There is hereby established in the state treasury the 911 state maintenance fund. All moneys received pursuant to this section shall be remitted to the state treasurer in accordance with the provisions of K.S.A. 75-4215, and amendments thereto. Upon receipt of each such remittance, the state treasurer shall deposit the entire amount in the state treasury to the credit of the 911 state maintenance fund.
(b)

Moneys from the following sources shall be credited to the fund:

(1) Amounts appropriated or otherwise made available by the legislature for the purposes of the fund;
(2) interest attributable to investment of moneys in the fund; and
(3) amounts received from any public or private entity for the purposes of the fund.
(c)
(1) Moneys credited to the fund shall be used only:
(A) To pay all expenses incurred in the administration of the fund; and
(B) development, deployment, implementation and maintenance of the statewide next generation 911 system; and
(C) to provide grants to eligible municipalities only for necessary and reasonable costs incurred or to be incurred by PSAPs for:
(i) Implementation of enhanced 911 service and next generation 911 service;
(ii) purchase of equipment and upgrades and modification to equipment used solely to process the data elements of enhanced 911 service and next generation 911 service; and
(iii) maintenance and license fees for such equipment and training of personnel to operate such equipment, including costs of training PSAP personnel to provide effective service to all users of the emergency telephone system who have communications disabilities.
(2) Such costs shall not include expenditures to lease, construct, expand, acquire, remodel, renovate, repair, furnish or make improvements to buildings or similar facilities or for other capital outlay or equipment not expressly authorized by this act.
(e) On or before the 10th of each month, the director of accounts and reports shall transfer from the state general fund to the 911 state maintenance fund interest earnings based on:
(1) The average daily balance of moneys in the 911 state maintenance fund for the preceding month; and
(2) the net earnings rate of the pooled money investment portfolio for the preceding month.
(f) All payments and disbursements from the fund shall be made in accordance with appropriation acts upon warrants of the director of accounts and reports issued pursuant to vouchers approved by the chairperson of the board or the chairperson's designee.
