Section 8-23-9-5 - Construction and maintenance when no satisfactory proposal received

If, in the opinion of the commissioner, no satisfactory proposal has been received, the commissioner may do the following:

(1) Purchase the necessary material and equipment.

(2) Employ the necessary labor.

(3) Perform the work of constructing, improving, or maintaining the highway or highways.
