Section 8-10-9-2 - Definitions(a) The definitions in this section apply throughout this chapter.(b) "Confined disposal facility" means a structure, an enclosure, a receptacle, or a disposal area established: (1) by an agency or instrumentality of the state or federal government; and(2) for the purpose of storing, retaining, disposing of, isolating, or holding dredgings or excavated material from the banks or bottom of a waterway; within a district created by this chapter.
(c) "District" means a waterway management district established under section 3 of this chapter.(d) "Waterway" means a canal, river, channel, or stream that is navigable for a substantial portion of its length by boats, barges, ships, or other watercraft for both commercial and recreational purposes.As added by P.L. 56-1994, SEC.2.
