As used in this chapter, "health records" means written, electronic, or printed information possessed or maintained by a health care provider concerning any diagnosis, treatment, or prognosis of the patient, including health information that is possessed or maintained on microfiche, microfilm, or in a digital format. The term includes mental health records, alcohol and drug abuse records, and information required to remain private under the federal Health Insurance Portability and Accountability Act (HIPAA) ( P.L. 104-191 ).
