Section 35-43-5-23 - Notary fraud; notarial fraud(a) The following terms are defined for this section:(1) "Acknowledgment" has the meaning set forth in IC 33-42-0.5-2.(2) "Notarial officer" has the meaning set forth in IC 33-42-0.5-19.(b) A notarial officer who, with intent to defraud, knowingly or intentionally: (1) affixes a person's signature to a blank affidavit or certificate of acknowledgment; and(2) delivers that affidavit or certificate to another person; with the intent that it be used as an affidavit or acknowledgment commits notary fraud, a Level 6 felony.
(c) A person who knowingly or intentionally uses an affidavit or certificate described in subsection (b) for any purpose commits notarial fraud, a Level 6 felony.Amended by P.L. 59-2018,SEC. 65, eff. 7/1/2018.Added by P.L. 128-2017,SEC. 26, eff. 7/1/2018.
