Section 34-52-2-7 - Attorney's fees in a class action(a) This section applies to a class action against the state.(b) This section applies to an action filed after June 30, 2017.(c) Subject to the requirements of this chapter, a court shall not award attorney's fees without conducting a hearing.(d) A hearing to determine the award of attorney's fees under this section may include:(1) presentation of evidence;(2) testimony of expert witnesses; and(3) any other evidence the court requires to make its determination.Added by P.L. 256-2017,SEC. 189, eff. 7/1/2017.
