Section 33-42-9-5 - Refusal to perform notarial act(a) A notarial officer may refuse to perform a notarial act if the notarial officer is not satisfied that:(1) the individual executing the record is competent; or(2) the individual's execution of the record is being done knowingly or voluntarily.(b) A notarial officer may refuse to perform a notarial act unless the refusal is prohibited by law.Added by P.L. 128-2017,SEC. 18, eff. 7/1/2018.
